Wats the eligibility criteria for an employee.

Case 1.
an employee has work only one day on jan 1st but has not resigned from the job. do v have to pay him for republic day or not ?

Case 2.
An employee has not worked on 24th & 27th. Do v hav to pay.

Case 3.
An Employee has worked only on 1st & 31st. Do v have to pay him.

Pls do suggest wat shld i do in such cases

First see under which of the Act you are to allow this national holiday & then go through the provisions relating to grant of the national holiday for your query.

Don't try to work on hypothetical basis, as your queries are incomplete and you are likely to get wrong or confusing advice in that case leading to wrong action on your part.

Your queries do not indicate what type of absence was of the employee, i.e., nature of absence from 2nd to 25th in 1st case, from 24th, 25th and 27th in 2nd case, and from 2nd to 30th of January in the 3rd case.

Whether the concerned employee/worker was on leave with full or half pay, or on casual leave, or on weekly off, or was absent unauthorisedly without pay. His wages/salary has to be regulated as per the nature of absence and how that is treated by the management.

For proper guidance, better intimate first the nature of absence in each case.

Hello to all,
I have quary of leave that we don't give off to the emploee if employee will remain abcence before and after theweekly off, and this is also same for the govenment off.
Please give status weather we are going right or wrong , if wrong please guide us for the same.....

Preceding and succeeding days should be attended for any paid holiday. in case of leave, it should be authorised.

Dear Mubashira,
In 1st & 3rd case, you have not to pay for the National Holiday, as the worker was on unauthorised absence, as the days preceding & succeeding the National holiday were not in the form of paid leave.
In the 2nd case, since the absence is authorised, as leave due and paid, you will have to pay for the holiday also.
NOW, you would have realized that you have received some wrong opinions earlier due to your having not supplied proper information through your original query.
