Can I Offer Fewer Leaves Than Required by Law? Seeking Advice on Leave Policy

Dear all,

I am drafting a leave policy for my company. As per the Punjab S&E Act, 1 EL is added every 20 working days, i.e., 18 EL in total. In addition, 7 CL and 7 SL should also be given. That totals up to 32 leaves. However, can I go below this prescribed number? For example, can I give just 12 EL? If yes, is there any provision in any law? Please help.

Welcome to CiteHR. Please go through section 14 of The Punjab Shops & Commercial Establishment Act, 1958 for your query. We are not allowed to lower the number of leaves. We do not find any provision under this Act which allows us to do such an act. These are the bare minimum leaves.
