Understanding Factory Laws: How Many Paid Leaves Are Employees Entitled to Annually?

Please let me know the total leave entitlement for an employee according to factory laws, including PL/CL/SL. I also need to know the total number of paid leaves allowed in a year without compensating for the same.

Dear Cutinha,

PL means privileged leave. CL means casual leave. SL stands for sickness leave. As per the Factories Act of 1948, the employer must provide leave (regardless of the name). An employee can take one leave for every twenty working days of the previous year, which amounts to 15 days. Now, let me explain how.

There are a total of 365 days in a year. If you deduct 52 days for weekly offs and 8 paid holidays, only 300 days remain. If we divide 300 by 20, you will get 15, which is the minimum number required as per the Factories Act.

Siba has clearly explained the provisions of PL (referred to as Earned Leave) in the Factories Act. Casual Leave (CL) and Sick Leave (SL) are as per the company policy, and there are no specific rules for this. If the employee is covered under ESI, then he becomes eligible for Sick Leave as per the provisions laid down under the act. Generally, companies offer 7 days of Casual Leave in addition to EL. Sick leave for non-ESI employees is not provided for.

I have my doubts about this. One is eligible for PL/EL only if one works for 240 days in the previous year. So the minimum leaves that can be given becomes 240/20 = 12.

Dear Srabanti,

The provisions of the Factories Act state that any worker who has worked for 240 days or more in a calendar year is entitled to earned leave at the rate of 1 day for every 20 days worked.

If the factory operates 6 days a week, then, as indicated by Siba, the weekly offs numbering 52 and the 8 holidays declared by the company will be the days on which the employee will not be working. Therefore, 365 days - 60 days (52 weekly offs + 8 holidays) = 305/20 = 15 days.
