Sir, can you urgently guide me? Is it a mandatory holiday for factories in the private sector on 14th October? I think it is not, but I need a notification to this effect as our employees are demanding it.
In the attached notification, it is mentioned that "all shops and establishments located in all markets will be closed." My question is, will offices and factories that are not located in markets also be closed or not? Please guide if anybody has received this type of notification or clearance.
Hi Bijoy, As per my understanding, it is mandatory to close the shops and commercial establishments located in the market area. In circumstances where a particular office or factory is not located in the market area, it is not mandatory to close.
I am working in a Pvt. Ltd. company in Okhla Industrial Estate Phase III, New Delhi, and we follow the Factory Act. Kindly advise us whether to close the unit or keep it open on the date 14th October 2010.
It clearly shows all market areas under the Delhi Shops & Establishment Act. If your organization comes under this, then you should follow this. Now, if there are one or two shops near your residence or office area, it is also called a market. The rest is up to you how you interpret the language used in this notification.
Our unit/factory is in the Wazirpur Industrial Area, Delhi-110052. Please confirm if 14th October 2010 is a holiday or not. Please reply urgently.
