Dear H.R. Friends,

A lot of confusion is being created in society regarding the amendment to the bonus act. Some individuals are of the opinion that it came into force from 1.10.2010.

We would like to clarify that so far, no bill has been presented by the central government regarding the Bonus Act. However, a private bill was introduced in March 2010. Until it is passed, no amendments to the Bonus Act can be made.

The Payment of Bonus Amendment Bill currently being circulated is a private bill. The government has not introduced any bill regarding an amendment to bonuses.

I understand that this bill has not been tabled in either house of Parliament. However, there are news reports that a bill has been passed by the Rajya Sabha and is to be passed by the Lok Sabha before the President gives his assent.

Dear All,

Can anyone suggest whether the 11% is in force or still pending? What is the status and effect of the Payment of Bonus (Amendment) Bill 2010 attached? Presently, we are calculating the bonus at 8.33% now. It could be very helpful if anyone confirms in detail about 8.33% or 11% which will be correct to pay for the current year starting from 01 Oct 2009 to 30 Sep 2010. (Tirupur, Tamilnadu)

Dear HR Professionals,

The proposal for changes is in the Bill stage. There should not be confusion in the minds of HR professionals. As of today, there is no change. If the Bill is passed by both Houses in the next session of Parliament and thereafter Presidential assent is given and then notified, it will change the bonus rates.

Sir,

I was working with a 54-year-old company until April 2010. When I asked for my bonus for the year 2009-2010, I was told that I am not eligible for the bonus as my basic salary is above Rs. 10,000. If that is the case, how did I receive bonuses in earlier years? Is there a clause stating that bonuses are not payable to employees who have resigned from the company?

Please provide me with an update.

There was a proposal to amend the Act, and accordingly, a bill was proposed in 2010. However, it has not been approved by the Parliament yet. Can this be implemented? As per our P&A department information, it is clarified that it can be implemented only after the Official Gazette is declared. Until then, the existing provisions are the only ones applicable.

Can anyone confirm?
