Are Daily Wage Workers Eligible for Gratuity and Pension Benefits? Seeking Advice

Please help me to know whether persons employed on daily wage rolls are entitled to Gratuity and Pension benefits.

Yes, if a person is employed on a daily wage basis, they are also entitled to gratuity and pension benefits.

I request you to elaborate on how to compute gratuity and pension for daily wagers if they have worked for 1 year and 7 months.

Dear Kosh, if he is not eligible, he cannot receive gratuity from the employer. For more information on this point, please refer to Section 4 of the Payment of Gratuity Act, 1972.

Any employee who works for at least 240 days in a calendar year for each of 5 years or more of his service period and fulfills the requirements of Sec. 4 of the Payment of Gratuity Act is eligible for the payment of gratuity, whether he is daily rated or monthly rated.
