Struggling to Withdraw PF After Leaving a Job? Here's How to Get Started

Hi,

I worked in a private company for three months. I am not able to get my PF forms from them. I need to withdraw the same. What is the form to be used, can that be downloaded from any site, and what are the procedures?

Hi,

You can get PF forms from the PF website. There is a PF withdrawal form No. 19 (attached) that you need to fill in and submit. However, before you can submit this form, you must get your PF statement either from your previous company or from their PF consultant. You also need to attach your bank details and resignation and relieving letters with the form.

Thereafter, you can get the same form signed by the HR of your previous company or by an MP or MLA and submit it to the PF office. The PF office will then process your PF withdrawal and deposit the amount directly into your bank account.

I have a situation; my employer is not providing me a relieving letter or experience letter. He is not allowing me to meet him. So how could I withdraw my PF? I have the PF statement slips provided by the company. I have worked at that company for nearly 3 and a half years. However, he is not willing to provide me with a relieving letter or experience letter. He is demanding that I pay the full salary (36k, not just the basic salary) for 3 months, even though my notice period is only 30 days. He has pressured me to stay and threatened to file a criminal case against me, potentially ruining my life. Consequently, I felt compelled to resign voluntarily. I am unsure if my Managing Director will provide any documents for PF withdrawal. How can I handle this situation? I have around 60k in my PF account. How can I withdraw it without needing to contact the employer?

Hi Nitin,

There must be some reason why your employer is behaving in such a bizarre manner. If you have worked for three and a half years, surely your relations must not be so bad as to cause your employer to react like this. The best option is always to go and have a straight talk with your employer.

No professional company can afford to behave in such a manner. If, however, your employer does not cooperate, you can always file a complaint with the labor court and also with the PF office. This, of course, requires that you have all necessary employment documents with you and also a copy of your resignation letter.

If you have all of these, then the labor court can order your previous employer to pay all dues. Also, you need not worry about the police complaint because that will automatically become of no importance if you file a labor case first.

I am working as an HR and recently started taking care of PF forms. I don't know what the procedure is and which forms an ex-employee has to submit to get their PF amount cleared.

The ex-employee just needs to fill in Form No. 19, which I have attached with my earlier post. He/she should attach his latest bank statement/passbook copy with the form and give the same to you. You are then required to fill in the employer's section of the form, attach his/her PF statement, sign and stamp the documents, and forward the same to the PF office.

Gurang has already enclosed the required form. Since you worked only 3 months, you need to fill Form 19 only, rather than Form 10C. For the withdrawal of the pension fund, the contribution period must be 180 days or 6 months. If it is less than that, no refund can be claimed.

Hi,

I worked with the organization from 1st April 2010 to May 2010. Now, I would like to transfer my PF to my current organization. According to my current organization, I have to fill out Form No. 13 along with Form 3A, Form 5, and Form 10. I have discussed this with my previous organization, but they are saying it is not necessary to fill out the above-mentioned supporting forms. Can you kindly assist me with the above query?

I worked with an MNC for almost 10 years and couriered my PF papers to the PF Delhi office, but I did not receive any confirmation from the PF office. How do I follow up with the PF office? Please help.

Do you wish to check whether your PF has been transferred from one employer to another or to check whether your employer has been depositing your PF deduction with the PF office?

@ Rose,

Please visit EPF Grievance Management System and put up your grievance. They can check and confirm whether your documents have been received or not. On a separate note, you should ideally send PF withdrawal documents by Registered AD post rather than courier. While post might take a few more days, you have a proper confirmation/receipt of delivery which the PF office can never deny.

Hello People,

There are some employees who do not want to opt for PF contribution. I am aware that we need to get a Form (I guess Form 9) filled from such employees and submit the same to the PF Department.

1. Can you confirm whether it is Form 9 or any other form number which needs to be filled by employees willing to opt out from PF Contribution?

2. Can someone send me a filled sample of such a form?

Form 13 is required for the transfer of your EPF/EPS accumulations from the previous organization to the current organization. In the case of accumulation transfer, Form 3A along with Form 5/10 is required. This is necessary as it confirms that the employee has resigned and the total accumulation for the contribution period is reflected in Form 3A. To expedite the transfer process, please ensure all the mentioned forms are enclosed with Form 13.

Please confirm the period of service.
If it is 1st apr'09 to May'10 you need to enclose form 3A for the last spell (Mar'10, Apr'10 & May'10) of financial year in the previous employment
No need to enclose the form 5 & 10,
It is very clearly writen in the form (end of the 3rd page of the form)

Hi, I have worked for a company for 4 months. I have contacted the HR of the company for the withdrawal of my PF amount. However, now the HR is telling me that I won't be getting the employer's contribution as an employee should be a part of the organization for a minimum of 6 months.

Is there any way to get the employer's contribution?

I think it's inappropriate to reply now. Nobody wants to leave a company easily. You couldn't understand why my employer is acting like that. Same with my question also, I went so many times, and he didn't give permission to meet him. I have been working sincerely for 3+ years, and when I decided to move out, this is the reaction I received from my employer. I feel like he expected me to work for him lifelong. If the environment is so good and the employer is taking care of me so well, why would somebody want to leave from there? As long as I am a person expecting a better work environment, I couldn't find fault on my side. I did a lot of good things for the company. I have never done anything against the company. The moment I expressed my decision to leave the company, I faced such a reaction. What should I do about that? Sit over there for a lifelong? If anyone could help me in this regard, how can I get my PF withdrawal without concerning my previous employer? Each time I go there, they treat me like some previous office boy, not giving respect as a professional at least. I don't want to go there again.

Dear Sir/Madam,

I worked with Pvt. Ltd. company for almost 9 years. When I asked the admin department to release my PF, they didn't take any action. In January 2015, I left the company. Now, after 6 months, I asked the accounting department, and I got a reply that the company didn't pay the last 1 year's PF installments. Now, I need to withdraw my PF. As per my knowledge, if the company didn't pay the PF installments, I will not receive my amount. In this case, kindly suggest what I need to do?
