Sick Leave Rules: Can You Use It When a Family Member Is Ill?

If somebody can tell me what the rules are for sick leave. Can sick leave be taken if a family member of the employee is ill? Please let me know the source of the information as well.

Sick leave, personal leave, casual leave, etc. (with the exception of Earned leave) are guided by company policy. Normally, if leave is taken because a family member of the employee is ill, it is called casual leave. However, as I mentioned, please check your company's leave policy to see if provisions for casual leave exist. Sick leave can only be taken if you are sick. However, you may take sick leave for a few days without any proof (medical certificate), as there are diseases that can be treated at home without referring to a doctor.

First of all, any type of leave cannot be claimed as a matter of right. You can only take sick leave when you are sick yourself. The number of sick leaves depends on the state act. In Haryana and Punjab, it is 14. However, if you are covered under the ESIC act, you are not eligible for sick leave.

First, examine which of the enactments is applicable to your establishment with regard to the grant of sick leave, for example, State Shops & Establishment Act, State Industrial Establishment (National & Festival Holidays and Casual & Sick Leaves) Act, etc. Then, go through the provisions/rules relating to the grant of sick leave in that particular applicable Act.

The importance of attendance in any company can directly impact the success of a career or, we can say, the future. If you have exceeded sick days for the year, as a result, they give additional "no pay" sick days. Although no company pays a salary to individuals who have exceeded the allotted sick time, the impact is much greater from the standpoint of creating savings and generating income for individual companies. Normally, all corporate sectors give 5 sick days each year. Sick days are not to be treated like vacation days and should only be used when necessary. Any organization does not expect all sick days to routinely be used. Sick days are used in situations where you physically or mentally feel that you cannot perform at a high level.

Leave policies vary from organization to organization. However, you cannot take it as a matter of right. Sick leave is specifically meant for an employee's own sickness. If an employee takes leave due to a family member's sickness, it falls under casual leave. In my company, we deduct sick leave for a maximum of 3 days; after that, the employee must submit a medical certificate. It is important to note that different types of leaves cannot be mixed. For example, if an employee has a balance of 2 sick leaves in their account and takes 5 leaves, they cannot use 2 as sick leave and the remaining as casual leave. They must either take all 5 as casual leaves or face 3 days of leave without pay.

Sick leave is nothing other than the number of tolerance days an organization allows for bearing the loss of working hours due to employee illness. If any leave policy is implemented in the organization at the time of an employee's joining, those days are the professional right of that employee. This leave is eligible only for absences due to your own health disorders. To avail of the leave for more than two working days, employees should submit a proper medical certificate. If the absence days overlap with tolerance days, the balance days should be treated as leave without pay.

An employee can avail sick leave if he falls ill. He cannot avail the same for his family members. The sick leave policy varies from organization to organization. Usually, in many companies, there is no need to submit medical certificates if an employee falls ill for up to 3 days. If the duration exceeds three days, the employee must submit medical certificates to the concerned HR department. In our company, there are 7 sick leaves which cannot be encashed.
