Changing Contractors: Do We Need New Registration and Labor License?

Dear friends, I need your help; please guide me on the following:

New Agency Work Allocation

1) For certain activities, the work has been allotted to a new agency. Do we need to get a fresh Registration Card (RC) from the Labour Commission, and will the new contractor be required to obtain a labor license from the labor authorities?

Previous Contractor Notification

2) The previous contractor, who was unsuccessful in bidding and whose registration is valid until December 2010, do we need to inform the Labour Commissioner about the labor employed by him up to now and the completion of work in the establishment by him?

No, there is no change in the RC. Only inform the labor office about the new contractor. Any contractor changes should be done according to your agreement with a one-month or 15-day notice period. After that, you can make the change.

New Contractor License Requirements

If he is a new contractor, he has to obtain a license in his name. The earlier contractor severed his links with the Principal Employer and his workers. Furthermore, the Principal Employer has to clear Form V for the new contractor to obtain a license. Please comment.

Amendment of the Registration Certificate

Amendment of the registration certificate is necessary to incorporate the name of the new contractor along with the period of the contract and the maximum number of employees engaged, etc. Additionally, you need to submit Form 6B - one for the outgoing contractor and one for the new contractor. If the new contractor employs 20 or more employees, Form 5 must be provided to them so that they can acquire a labor license.

You have to submit the application for adding the new contractor with their details. Only then can the new contractor apply for a license under CLA.
