Struggling to Get My Gratuity After Resignation: How Can I Legally Claim It?

Hi,

I worked with an IT company for the past 10 years. I resigned in December 2009, providing the required one month notice to my employer. However, I am currently facing issues as my employer is unwilling to provide the gratuity owed to me. I am seeking guidance on the legal process to obtain my gratuity amount.

Dear R.N. Khola,

I have been trying hard to get my gratuity amount from the employer. I sent three letters to LIC, from where the gratuity scheme was taken, but unfortunately, I am not getting any feedback from LIC.

I have come to know that the employer has withheld the gratuity of 3 to 4 employees and communicated verbally to them that the same will not be paid.

Please advise on what needs to be done.

Dear Ganesh, Please file your claim case before the Controlling Authority under the Payment of Gratuity Act, 1972 in your area. We need to file our claim case against the employer. It is the employer's responsibility to address the matter if they are insured with any agency or LIC.
