Employer Earned Zero Salary This Month: Do We Still Pay Their MLWF Contribution?

If any employer is absent for a complete month and earned "0" salary for that month, do we need to pay his contribution of MLWF? If yes, then from where will we have to pay? Kindly guide. Please reply urgently.

I believe the Mumbai Labour Welfare Fund Act does not speak about the monthly salary he earns, but it speaks about the employees on muster rolls as of December of the year. Thus, MLWF is payable. I'm not aware of the MLWF Act, but it should be similar to the one applied in my state.

But if that staff is not present for a single day in that particular month, then who will be going to pay his part of the contribution?

Please help me urgently.

LWF Payment Obligations

1) LWF has to be paid for all employees who have worked for at least 30 days in the calendar year, irrespective of whether they are dismissed, discharged, or have resigned from service.

2) The employer is authorized to deduct employee contributions from their salary.

3) If the employer, through inadvertence or otherwise, has not deducted, it can be made from the wages of such an employee for any subsequent month with permission in writing from the appointed inspector.

4) Deductions from wages, as enshrined in the "Payment of Wages Act," have to be made.
