Dear all,

I wanted to know if there is any law or precedent under which it is stated that the granting of earned leave to employees is mandatory. If there is any, then please tell me about it.

Please reply.

Hello, The Bombay S&E Act provides for the encashment of leaves under Sec 35(2) in conjunction with Sec 36. The encashment of leave is only possible upon exit and is not stipulated on a yearly basis. However, some employers pay it on a yearly basis as well for any unutilized leave over and above the carry forward limit. It depends on the company.
