Shouldn't there be an attendance register for managers/HODs as well? Can the HR manager make it compulsory for another HOD in the same company to sign an attendance register every day?

As per the law, it is mandatory to sign in the attendance register from the top level to the bottom level, i.e., from managers to office boys.

Yes, it is mandatory for all levels of employees to sign the attendance register. Of course, if they feel that their record does not make a difference in their leaves, salary, or other compensations, they can refrain from signing.

There is no law requiring an employee to sign an attendance register. However, maintaining an attendance register is mandatory under various acts within labor laws and the Factories Act. Employees paid up to Rs. 10,000/- are covered under labor acts, whereas individuals such as HODs (highly paid) are not covered under these laws. Those who claim that signing the attendance register is mandatory according to the law are incorrect.

As a matter of discipline, every employee in an organization should record their attendance properly, as they are paid wages based on the days they work each month.

Hi,

Yes, the HR Manager has the authority to maintain such a register in the purview of HODs' attendance in the company. It will also help to resolve any salary preparation problems regarding attendance.

Let us consider this:

1. As per the Income Tax Act, every employer is supposed to maintain full and complete records for their employees' pay, salary, how that salary and pay are calculated, and finally paid, and whether proper tax is deducted. So, for making calculations of pay, salary with giving benefits or leaves, government holidays, and overtime pays, it is necessary to know that a person has worked in the office under the employer for a specific number of days. Therefore, the company has to maintain a record of proper working and the number of days a person worked. It is clear that attendance records for even top bosses, CEOs, and C&MDs are required.

2. As per the Insurance Act, if any untoward incident happens, then for assessing the claim, it will be the responsibility of the person who suffered to prove that he was at the workplace (office or factory). For this, he has to show a record from the attendance register that he came to the office and was, in fact, there. In one case, an employee was coming by car, and a tree fell on his car while he was parking it in the parking lot and got injured. The court said that since he had not begun working at the office because he did not sign the muster at the beginning of work in the office, it cannot be said that he got injured in the office, and the claim was not paid. So, again, proper attendance records are very important.

Let's not mix up the conventions and the internal policy matters with the law. I do agree it is important to have equity in the procedures for all levels. However, terming it as law would be a bit far-fetched.

If the company wishes, it can do away with the attendance register altogether. In many organizations, the practice of signing the attendance register doesn't exist.

If we all are self-disciplined and the good practices are internalized, then there would be no need for signing the attendance register. In Indian conditions, it doesn't happen so easily, and many will abuse the doing away of signing the attendance register.

Dear Sunil, First, decide which of the Acts is applicable to your establishment in relation to the maintenance of these registers. Then, go through your applicable central or state Rules to find out the formats for maintaining these registers.

Dear R N Khola sir, please let me know under what act and section this attendance register falls, and what actions can be taken when a person does not sign it. This individual receives a substantial monthly amount, let's say 50,000 to 60,000, yet fails to sign the attendance register.

Dear Rajan, First, examine the various labor laws to determine under which Act you are required to maintain an attendance register. Then, check if there is a provision for signatures on this register under that Act and its Rules. Attendance registers or muster rolls are required to be maintained under the Minimum Wages Act, Factories Act, Contract Labour (R&A) Act, State Shops & Establishment Act, etc. I am not familiar with other states, but in Haryana, under The Punjab Shops & Commercial Establishment Rules, 1958, we are required to maintain an attendance register in Form "C," where both the employer and employee must sign. This register is required to be maintained under Rule 5 of these Rules.
