Clarification For Earned Leave As Per Factory Act.

Dear Colleague,
Plz. let me know, as per factory Act, If any employee is on Earned Leave and weekly off or any Holiday falls during that very period then Weekly off or Holiday will be counted as EL or not. Please clarify me at the earliest and mail me the clarification at [Login to view].

i too have the same query, and as per my reference it is calculated as leave but no evidence as per law has been located

Dear Ashish,
If your unit is covered under the Factories Act, 1948 then go through chapter VIII on annual leave with wages for your query.

Dear Mr. Khola
I have gone through Sec VIII but no where it is mentioned about the above query, as if 3 days are deducted then the workers will be on losing side as they would be penalised for being absent although they are not paid for weekly off days.
I have to show evidence to mgmt for not deducting the leave fir 3 days.

Plz go through section 79(1) explanation 2 of Factories Act, 1948 for this purpose.

If an employee possess prior approval then all weekly off and holidays should be waved off.
