Earned Leave and Holidays: How Does the Factory Act Handle Overlapping Days?

Dear Colleague,

Please let me know, as per the Factory Act, if any employee is on Earned Leave and a weekly off or any holiday falls during that period, will the weekly off or holiday be counted as Earned Leave or not? Kindly clarify this for me at your earliest convenience and email me the clarification at jkphrm@gmail.com.

I too have the same query. As per my reference, it is calculated as leave, but no evidence as per the law has been located.

If your unit is covered under the Factories Act, 1948, then go through Chapter VIII on annual leave with wages for your query.

I have gone through Section VIII, but nowhere is it mentioned about the above query. If 3 days are deducted, then the workers will be on the losing side as they would be penalized for being absent, although they are not paid for weekly off days. I have to show evidence to management for not deducting the leave for 3 days. Please help.

If an employee possesses prior approval, then all weekly offs and holidays should be waived off.
