The availability of Comp-Off depends on the company. It is generally mentioned in the Leave Policy of an organization. In my previous organization, there was a maximum limit of 3 months for availing Comp-Off, whereas in my current organization, it is available for the whole year.
In our organization, we have to take the Comp Off within 1 month; otherwise, it will lapse. It is purely in the hands of the management to decide the same.
Compensatory Off (Com. Off) is granted in accordance with the provisions of the Factories Act. It is provided to employees who work on a scheduled Weekly Off day. Com. Off can be taken within a month in which the holidays/Weekly Off were due or within the two months immediately following that month. Employees are entitled to compensatory holidays of an equal number to the holidays they missed.
All the above points are correct. Comp off can be taken within one month and can be extended to up to two months i.e. from the day worked on a holiday or weekly off, counting from three months starts.
The comp time off can be availed as per company leave policy. In most industries, it is for a maximum of 3 months. The calculation will exclude the month in lieu. In special cases, the company management may extend the period for availability.
As per the Factory Act, any compensatory off due should be given in the following weeks. However, it also depends on the policies of each individual company.
In our previous organization, we used to take compensatory time off every three months. However, if it was not feasible to take time off, the organization had decided to provide an option to encash the same. This policy may vary depending on the individual organization.
