How Does the April 14th Holiday Affect Your Work Plans in Central Government Offices?

It has been decided to declare Wednesday, the 14th of April 2010, as a Closed Holiday on account of the birthday of Dr. B.R. Ambedkar for all Central Government Offices, including industrial establishments throughout India. The notification regarding this decision is attached.

Thank you for the update. Please clarify whether the upcoming holiday will be compulsory, similar to Republic Day, Independence Day, etc., and whether it is applicable to all industries and factories.

This is nothing else but vote bank politics... Maybe Madamji is too afraid of Bahanji nowadays. This is one of the low points in Indian politics that someone like Dr. Ambedkar is dragged into vote bank politics. God help Indian democracy.

14th April 2010 will be a closed holiday for all Central Government offices and industrial establishments under the Central Government. It is not applicable for other public Ltd/private industries as well as state-owned industrial establishments.

Although the circular was sent from the central government department, we have not yet received any notice in our company. This implies that there will not be any holiday.

Holidays for private industrial establishments are governed by the National Festival Holidays Act and not the Negotiable Instruments Act. Therefore, it is not applicable to private industrial establishments.

Dear Ramalinagam,

Kindly clarify the difference between National Holiday and closed holiday. Since the Declaration of a holiday on 14th April 2010 - Birthday of Dr. Ambedkar is a closed holiday. Whether the aforementioned holiday is compulsory for all establishments i.e. shops, commercial establishments, banks, PSUs, etc.

Hello to all,

National Holidays are declared and governed under the provisions of the respective states' INDUSTRIAL ESTABLISHMENTS (NATIONAL AND FESTIVAL HOLIDAYS) ACT, [the 'Act]. There may be slight variation in the Act of each state. However, more or less the scope or objective is the same.

If your state's Act has declared April 14 (Dr. Ambedkar Jayanti) as a compulsory holiday, then it is a holiday in your state for all industrial establishments. To know what an 'industrial establishment' is, please refer to the definition of the same in the Act. If it is not a compulsory holiday, then it will normally be in the list of non-compulsory holidays.

With regard to the attached Office Memorandum, the same is issued by the Government of India, Ministry of Personnel, Public Grievances & Pensions (Department of Personnel & Training). It is applicable only to Central Govt. Offices and the industrial establishments belonging to the Central Government (i.e., Government of India). The notice itself is self-explanatory on this issue.

The words 'including industrial establishments' should be read in reference (and in continuation) to the preceding words i.e., 'Central Government Offices' and should not be read independently.

So those who are entitled to a holiday, 'enjoy' and for others 'let's work hard'.

Our Company's Head Office is covered under the Shops & Establishments Act in West Bengal, and Factories in West Bengal, Orissa, and Assam are covered under the Factories Act. Is this April 14th holiday applicable for us?

Irrespective of under which act/legislation your company is registered, the national holidays are governed by the respective states INDUSTRIAL ESTABLISHMENTS (NATIONAL AND FESTIVAL HOLIDAYS) ACT, [the 'Act']. Therefore, please refer to the Act in your state before deciding on what is the definition of an 'Industrial Establishment' in your state. It could cover a shop/commercial establishment/bank/factory, etc. Furthermore, KPO/BPO would also generally come under the respective state's Shops and Commercial Establishment Act.

Please note that unless the holiday is declared under National and Festival Holidays, we cannot implement it. The Negotiable Instruments Act is applicable only to government offices.
