Navigating Short-term Hires: Do We Need to Report Temporary Labor in Returns?

In my company, there is already one contract labor registered for housekeeping. According to the contract act, we are filing returns to the labor office, mentioning the above contractor. Now, we have hired 6 to 8 laborers from outside for civil work, just for a period of ten to twenty days. My question is, should we mention these hired individuals in the return?

Hi,

You cannot engage contract labor without a licensed contractor whose name is listed in the registration certificate granted to you by the Labor Dept. If no civil contractor is listed, make necessary amendments to your registration certificate by getting them enrolled and then engage contract labor through them for civil work. Filing a return is a statutory obligation on your part for all the contract labor you have engaged.

We are a subcontractor for manpower outsourcing. In this case, who will sign Form-V, the main principal employer or our contractor/our principal employer.

I am sure only the Principal Employer can claim the labor force. Labor force cannot be claimed by two organizations, i.e., contractor and subcontractor. In my case, the Principal Employer has given permission to the main contractor, and the contractor managed subcontractors. In response to an RTI query, the Principal Employer expressed that he is concerned with the Main Contractor and not otherwise.

On the other hand, I found that the Labour Officer was suggesting the main contractor recommend a license for subcontractors. I do not know the reason, but the Principal Employer is the only one involved in this matter.
