Is It Legal to Resign During Probation Without Notice if I Offer Payment Instead?

Hi, I have resigned from an organization during the probation period without providing the required notice period. I communicated my resignation three times and requested their acceptance. I offered to pay in lieu of the notice period.

My question is, is it mandatory to serve the notice period if I am willing to make a payment in lieu of it? The company has not accepted my resignation and is not issuing a relieving letter, insisting that I serve the notice period. Can you please advise if any legal action can be taken according to labor laws?

Please refer to your appointment letter issued to you when joining the organization. Go personally to your HR Department and politely inquire about the buyback of your notice period. Give them assurance that you will provide all the necessary knowledge sharing and ensure a proper handover to your successor.

Next, inquire about your relieving letter and clearance form, and proceed accordingly.

One of my friends has recently resigned from his company, but as he could not complete his notice period, the company will not give him any release letter. Additionally, his new company does not require a release letter from him. However, I have suggested that he should obtain a release letter from his current organization for his future career.

Request for Release Letter Format

Please provide a letter format where he can write a letter to his HR requesting the release, as he is willing to pay for the notice period.
