Can I Transfer My Gratuity to a New Employer? Seeking Advice on the Process

Dear all,

If I work for a company, say, for 2 years and then leave to join another company, is it possible to transfer the Gratuity amount accumulated with the last employer to the new Gratuity account with the new employer? If possible, please let me know what the procedure is.

Under the Payment of Gratuity Act, 1972, we do not have any system of opening any account for an employee.

I just wanted to know if it is possible to withdraw or transfer Gratuity funds accumulated if I leave a company before five years.

Dear Vikash,

If your employer has any fund under any of the Gratuity Rules, then you should go through those rules for provisions of fund accumulation, its transfer, and withdrawal. However, the Payment of Gratuity Act, 1972, does not have such provisions.

Dear Friend,

There is no system of transferring the gratuity amount from one organization to another. An employee is eligible for gratuity in a company only when he/she completes his/her five-year term of service. If an employee leaves the company before the completion of 5 years, he/she will not be eligible for gratuity, which is a direct benefit of the company.

Note: Gratuity account cannot be transferred to another employer like EPF, which can be transferred.

Please reply to my query. I worked in a Central Government PSU for 5 years and 4 months and then joined another central government PSU through the proper channel. Out of this 5 years and 4 months, the first year was considered a training period, and I was given only a consolidated stipend (though the CPF was regularly deducted from day one, even from the stipend).

Gratuity Eligibility and Transfer

What is my length of service (4+ years or 5+ years), and am I eligible for gratuity? Can this gratuity be transferred to my new company? What is the transfer procedure?
