Dear All,
Please let me know the Leave Rules / Policy followed by most of the organisations.
If a employee is confirmed and has not completed a period of one year in the organisation than what to do with his/her paid leaves i.e., CL ?
When should be the paid leaves encashed by the company ?
Looking forward to have a positive response your side.
Thanks & regards,
Nikita

Dear Nikita,
First examine which of the enactments are applicable to your organization regarding different kind of leaves & then go through leave provisions in those Acts for your query.

Dear Nikita,
Greetings for the day,
I advice you to go through the certified standing order of the company in which you will find the leave rules.
As far as our company is concern they are providing 7 cl (casual leave), 7 sl (sick leave), 15 el (earned leave) to every employee in a calender year. As far as sick leave is concerned only those employees who are not covered under esic should enjoy the same.
For availing the facility of el an employee should work for 240 days but on every 20 working days 1 leave will be credited in his account and if he leaves the jobs without completing the 240 days leave encashment will be paid to him of his leave whatever be in his account. Encashment is only done of el not of cl/sl. the formula will be.
basic salary/26* no. of el.
hope this be sufficient to clear all cofusion,
thanks & regards,

Thanks Sumit. I have another related question.
What about loss of pay? I mean what is the calculation used?
I assume, no.of.days on LOP * basic salary/28. Please correct me if I am wrong.

Dear senior
I have one doubt in leave rule. is there any rules of El's encashment ? if not El's are carry forward or not.
sumitk.saxena
There is encashment of EL during retrenchment, resignation, termination or retirement and it should also be carry forward when a person is continues in employment.
thanks & regards,
