Understanding Minimum Wages Act: Are PF and ESIC Deductions Separate for Mumbai Shops?

Dear All,

My company is registered under the Shop and Establishment Act (Mumbai). Is the Minimum Wages Act applicable to us? Do we deduct PF and ESIC from the prescribed minimum wages, or are they to be kept separate from them?

The Minimum Wages Act is applicable to all establishments covered under the Shops and Establishments Act. The deduction of PF and ESI contributions from employees' wages may be made from these minimum wages, and if there is any employer's contribution, it shall be in addition to the Minimum Wages. You can use the Google search engine to find the Maharashtra state government Minimum Wages Act for the rates or contact your local Labour Welfare officer for the same.

Irrespective of the type of industry or area of employment, the application of minimum wages as per the Minimum Wages Act, 1948, is mandatory all over India. The respective state government, through its Gazette, notifies the applicable rate of minimum wages every year (which is available from the local booksellers who sell official forms/stationery - my attempt to get the updated information from the net was not always successful).

It is classified as per zones, industries, and cadre. You can apply the above classification according to the cadres deployed in your industry/zone.

Applicable rates of PF, ESI, may be recovered/paid from the rate payable to the individuals.
