Factory Holidays on Sundays: Can We Swap Festival Days for Working Days?

Dear All,

If any factory holiday falls on a Sunday, is it treated as a factory holiday? Secondly, suppose August 15th or any festival falls on a Sunday, can we include any other festival falling on a working day in lieu of August 15th or that festival?

Dear Menka,

In any factory, festival, and national holidays would be observed under AP National and Festival Holidays Act in Andhra Pradesh. Generally, if any Festival Holiday falls on a Sunday, we will have the option to choose a holiday for some other festival. However, if any national holiday such as Jan 26, Aug 15, Oct 2nd, etc., falls on a Sunday, employees will lose such holidays, and there is no possibility to get another holiday in place of the national holiday falling on a Sunday.

There is no prohibition that if your management considers granting a holiday in lieu of such a day, no one will say no to it. Still, there is no need to give any substituted holiday. I hope this is clear to you.

I agree with Harindra. Basically, it's your company policy as to how many holidays you want to give. However, as per the National & Festival Holidays Act, the company has to declare certain mandatory holidays. These include Republic Day, May Day, Independence Day, Gandhi Jayanthi, Rajyotsava in Karnataka and Andhra Pradesh, and Thiruvalluvar Day in Tamil Nadu. Even if these holidays fall on a Sunday, you must still show them on your holiday list. This list needs to be displayed on your notice board or in a designated place where you post all your notices.

It totally depends on your company policy. If you are a policy maker, then you can make changes as per employee and company benefits. If you are an employee, you can put forward your suggestions to the management, citing company and employee benefits.

Additionally, you can provide any holidays; there is no need to give any alternative holidays. It's up to your company policy.

Please find attached a list of holidays issued by the Central Govt-Delhi office. I hope you will find some help with this.

National Holidays need to be observed on the days they fall as per the National and Festival Holidays Act in all calendar years. The year 2010 appears to be a holiday calendar with many Sundays as holidays. If management can adopt a benevolent attitude, some of these benefits can be extended to the employees in your organization.

Hi All,

This is Namita Rai, working with an IT company in Pune. I have a query regarding the leave policy structure. We provide 18 paid holidays (including SL, CL), 14 listed holidays (national holidays), 2 marriage leaves, 1 birthday, 1 anniversary, and 1 special festival leave for the year. Now, I want to know, if an employee chooses to take 1 festive leave, should that leave be adjusted with any listed holiday leave or should it be an additional leave? Is there a specific policy for such festival leaves? I would appreciate any guidelines on how to allocate these special leaves.

Holiday Policy Inquiry

Is there any policy stating that apart from the national holiday, only 8 or more or less other festivals are to be given as holidays for the entire year, or can there only be 8 holidays for the entire year? What if any festival falls on a Sunday? Is it possible to adjust it to any other working day?

In any private company, how many holidays are considered in a year, including national holidays?
