Seeking Guidance on Legal Salary Limits for Overtime Pay in an MNC Setting

Dear Friends,

Please help me to know the maximum wages/salary limit for the payment of overtime. I am working as AM (Human Resources) in an MNC, and the salary of our staff is good enough (more than 20,000/- per month). Some of our staff are staying late in the office.

I need your help to know the maximum wages/salary limit (some documentary proof) so that I can tell the management that it is applicable as per the law or not.

Dear R.K. Chauhan,

First, examine which of the Acts is applicable to you for the payment of overtime to the employees, i.e., the Factories Act, 1948, Minimum Wages Act, State Shops & Establishment Act, etc. Thereafter, go through the definition of worker/employee in that particular Act and see whether there is any wage/salary limit.
