My name is Ashutosh, and I have been working with XYZ company for the past 18 months as a subject matter expert. I was terminated from my position because I was found to be breaking company policy, but I did not, and they do not have any proof as well. Now I have some queries for senior persons. Please suggest.

1. Can I join another reputed company and showcase my experience there?
2. If the new company conducts a reference check with my previous employer, would it be positive or negative?
3. How should I go about searching for a job in this scenario?

Before opting for a good job, try to clarify the misconception that happened against you. You have been terminated from the company for breaking the company rules, which you haven't done. So, why don't you talk to them? After all, you have all the rights to know the truth of your termination.

As far as reference check is considered, talk to the company that is offering you the job about whatever happened in your previous company and on what basis they have sacked you out of the job without you being responsible for it. There are more positive chances of telling the truth to them.

You can very well carry on with your job hunt and tell the interviewer what happened exactly because if they find out about your termination after you have joined the company, things might turn unfavorable for you. So just stay cool and keep looking for a good job.

It all depends on what we strongly believe. Just try once telling him honestly what has happened in your previous office; it might work. If things still are not happening as you think, give the number of some good manager who knows you well for reference check. That's all.

Assuming that you are clean in this case, it is always better to speak out the truth in the interview. At most, you may be rejected in a few places, but you will feel good about yourself and be more confident. Interviewers are also humans, and there will be those who understand your position and hire you. So the question of you not getting a job does not arise. When God closes one avenue, He opens another, so don't worry.

This is not just philosophical. I have personally hired people with a tarnished background, and trust me, they have kept up my faith in them.

Is there any security officer in your organization? You should approach him and ask for the investigation. If there is no security officer there, then through a step ladder, you should approach your head and clarify what exactly the situation was. Then, you should go for another company after you think everything is fine or collect proof in your support.

Yes, they have provided me a termination letter stating that I am suspected of breaking company policy. They have not provided me any salary for the notice period as well. Moreover, they are sending emails to other companies in the same field stating that I have been terminated due to such and such reasons.

Can legally management take me back-25 person case in Mumbai court in High Court

150 confirmed employees were terminated in January 2003 by Wockhardt Pharma because of the union. Since then, I have kept faith and been assured time to time by management on the cell and phone to give me back my job for more than 6 years. Still, it's not a reality. Only 25 people of the union are in court in Mumbai. Can you all tell me the truth since there are 25 people in court against the company and hence raised legal complications if the company restores my services? In Wockhardt, certain top management people want to give me a job, but they are not making a decision. My track record is unblemished with countable achievements.

For the last six years, I have been waiting for justice. Can you give me the truthful information so that I can present the facts to the chairman and HR head? If you are sure that you are clear about your mistakes or you have not made any mistakes, then you can try to search for a new job. Regarding the previous employer, if they are not listening, don't talk to them. You can send a letter by registered post stating on what basis the company terminated my job.

If your current employer investigates you from your previous employer, please do not fear. Go ahead and accept all challenges. If you really made a mistake, then do not provide a reference and try to change your attitude to avoid repeating the same mistake. You can seek our help to get answers from your previous employer.

First, please clarify the following:

1. What kind of industry were you in?
2. Were you employed for more than 240 days?
3. In such a case, you cannot be terminated without a valid reason. If they have terminated you, was it done orally or through correspondence?
4. You could have approached the courts for redressal.
5. If you are seeking a new job, you must clearly explain what transpired in your previous company.
6. Just like individuals, there are companies managed by good and bad persons, so you will always have a chance.
7. If something unknown happened in your previous company, whether knowingly or unknowingly, try to rectify it.

You say you did not break company policies but you are punished without proof. It sounds absurd to me as no one can frame charges of this nature without any proof. It is then an overt signal that the Company does not like you to continue as in almost all Private Companies such methods are followed to make the employee resign. You have rather been terminated, in which case you will not be given any relieving order.

You did not mention anything about your giving an explanation to the Management on flouting the Company Policies. You should have pacified them to get relieved amicably instead of getting the termination order, which would definitely hamper your career prospects.

From your way of blaming the HR department as a whole, I infer that your relationship with everyone, including HR personnel, should have been strained all along or on a particular instance.

A piece of suggestion to you, my friend. Please keep good interpersonal relationships with everyone, especially with your superiors, lest the future will be difficult for you.

1. If you show your experience in your previous company, definitely you may have to produce proof and a relieving order. The new employer will not take it fairly when you blame the previous company.

2. In the absence of a Relieving Order, definitely the new employer will make a reference, and it will be surely negative for you.

3. Under the circumstances, please bank on your talents, knowledge, and experience instead of depending on the blame game, and please be frank with your new employer on issues involved in your previous company and tell the new employer the good lessons you learned from those bitter experiences. That will create a good opinion about you in the minds of the new employers.

Just as our friends stated, I too agree with them. First of all, you must have clarity and be convinced about the termination by your mentors/reporting officer. Being positive, you will definitely have more opportunities from your bad experience. People make mistakes commonly, but the ones who learn from their mistakes are the ones who make the most of their learnings.

First Option:
In your case, you should write an email to your Managing Director or President, brief them about the facts, apologize, and request that the feedback be positive when checked by the prospective employer.

Second Option:
File a case against the employer through an advocate and also register a complaint with the Labour Commissioner's office to seek justice.
