Understanding Resignation vs. Termination: Who Holds the Resignation Letter in Court?

hello subbu
What is the difference between acceptance of resignation and termination? When does the acceptance of resignation become termination?

In a judicial proceeding before the labor court, who has to produce the copy of the resignation letter: the employee or the employer?

In Karnataka, if an application under Section 33C of the Industrial Disputes Act is dismissed, what is the next remedy?

Dear Friend,

Resignation means "an employee submitting their resignation voluntarily, which is then accepted by the company's management.

Termination means "an employee being dismissed by the company at the discretion of the management". This is also known as receiving a Pink Slip.

Termination can be categorized into two types:

1) Usual termination, i.e., Pink Slip.
2) Where an employee decides to resign in order to circumvent any obstacles in their future career.

In cases involving legal proceedings, if an employee presents their resignation letter, the management is required to provide a copy of the accepted letter as well.
