by virtueof amendment in payment of gratiuty act in dec2009,private school teachers who were not coming in the definition of employeesas persupremecourt decision,are now within the definition of employeesas per amendmentmade in sec 2e and alsobyadding section13a ,the effective date is april1997,hence privateschool teachers retired afterapril1997 should approach to their schoolmanagement for payment of gratiuty,if denied by them ,you may approach statelabour court for appropriate directions to school management.
