Understanding Employee Holiday Entitlements: Is There a Fixed Number by Law?

Can you please tell me the number of holidays that may be given to employees in a year? As per statutory compliances, is there any fixed number?

Hello Vidya,

It depends on the kind of organization you are working with. If it is a manufacturing unit, the leave rules shall be governed as per the Factories Act. If it is covered under the Shop & Establishment Act, the leave rules should be governed as per the State Shop & Establishment Act. You can refer to the respective act as the case may be.

Hi Vidya,

I agree with Negi that the number of holidays completely depends on the type of organization. I am working with a BPO, and we give 10 holidays in a year. If your company is related to the State or Central Govt, you need to follow the norms set up by them.

Our company is a software company that operates for 5 days a week. Are 10 holidays, excluding events that fall on weekends, acceptable?

Dear Vidya,

The usual must holidays are Independence Day, Republic Day, and Gandhi Jayanthi. However, you cannot ignore occasions such as May Day falling on May 1, 2006, the State formation day - Karnataka Rajyotsava Day in Karnataka falling on Nov 1, 2006. Apart from the above 5 days, maybe 5 holidays for Festivals and other occasions should suffice the requirement.

Incidentally, for a 5-day workweek, the number of actual days worked in a year is as follows:
- 2 days off in a week = 52 x 2 = 104 days
- Paid holidays as above = 10 days
- Minimum paid leave (1 day for every 20 days worked) = 251 (365 - 104 - 10 days = 251, 251 divided by 20 = 12.5 or 13) = 13 days

Therefore, the total days not worked = 127 days. The total days workable = 365 - 127 = 238 days = 65% of total workable days!

We have not heard of the UP Regulation Act having any format for a list of holidays.

As per the Factories Act, you are required to provide a privilege of 9 paid holidays. This includes 5 festival holidays and 4 national holidays. At the end of the calendar year, you must select the holidays for which you will be granting the aforementioned privilege and notify the relevant government authority. In our case, the government authority is the Institute of Factories.

The Factories Act, 1948 does not have any provisions relating to the grant of National & Festival Holidays. The list of holidays is declared/granted under the state Act.
