How Can I Get My Unpaid Salary and Documents from My Former Employer in India?

Season's Greetings! I was working for a private company in India whose Headquarters is in Mumbai. I have just finished a tenure of one year on 23-07-09 with them. However, the company has not paid my salary from September 2008. I used to go to my office until November 2008. After December 2008, I had stopped going to the office, but I have not resigned. Now, on 23-Aug-09, I have mailed my resignation to them, but they have not replied yet. I think they are not in the mood to pay my salary that is due to them.

Please help me with what I can do to get my due salary, salary slip, and experience letter from them.

File a case under the Payment of Wages Act. You can file it in Bombay or the place where you were working, provided they have any office there.

Dear Praveen,

From your information, it is clear that your monthly salary is more than Rs. 10,000 per month, and therefore, you cannot avail the relief under the Payment of Wages Act, 1936. You will have to seek recourse through the civil court for your salary. Therefore, it is advised to seek the assistance of a civil court advocate for filing the case.
