Labor Supply Contracts: Who Deserves a Paid Holiday in Our Company?

Hi All,

In our company, we have given a labor supply contract to different contractors. As per our requirements, they have to supply the labor. Now, the problem is regarding the weekly off/paid holiday matter. Who will get the paid holiday? Will it be any workmen who work continuously for six days or those who are present one day before or after the paid holiday? Please help me.

Dear Mantu71,

Weekly off days are governed by the Minimum Wages Act, Factories Act, or State Shops Act, etc. Holidays are governed by the Industrial Establishment (National, Festival, Casual, and Sick Leaves) Act or the State Shops Act. Therefore, first, examine the status of the applicability of the different labor laws and then go through these provisions to take necessary action in the matter.

Weekly off is applicable to them but not paid (26 days calculation). In case of holidays like 15th Aug, 26th Jan, etc., they must present one day before or after the holiday.
