No Leave On 15th Aug

Hello Seniors,
Our Office will remain Open on 15th Aug 09. what are the nessesary steps we need to take? Do we need to pay 2 cr. Leave to staff?

We do hope that you are running your office in any of the States of India. Office are covered under the Shops & Commercial Establishment Act & if your state have enacted this Act then go through the provisions relating to the grant of holidays. You will find answer to your query.

As per shops Establishment act, its should be holiday even u pay double the salary. we cant over come this kind of provision ...

Hello,
I would like to know if Corporate Offices can be granted a leave on the 15th August. In this office - there are certain old employees (like been with teh company for more than 15 yrs), who brainwash the mgmnt by saying "Leave is all not necessary"
and they come here and slog.

In India, National holidays = 3 (15th August,26th January and 2nd Oct)
It is across the country,every one must observe these holidays,and service industries or those critical operations which can not be stopped to enjoy holidays in such cases the employees on duty on these days must be given a compensatory holiday or overtime pay as per the individual company policy.
Read the act to understand the importance of national holidays,the mere reason being it is a national hoiliday no employer or employee has any right to argue on if it can be a working day or not.
I am sad it is on Saturday,missing a long weekend.:(:(

Dear Madhura
If ur employees works on national or festival holiday, U need to fill the form 4E and sent to the IF office before one week. In that form u need to mention the employee name, department and the shift.
The employee who worked on National & Festival holiday has to pay double wages or a leave with wage any thing the management wish. It will be Practice in the service industry & in some urgent cases it will also followed manufacturing industry...........

One can't open any office or establishment on the specified national holidays under any circumstances and no one can force any employee to come on that Day. It's an irony that many people are lured by the extra money or compensatory holidays and give scope to employers for forcing other employees also to come on that particular day.
15th August, 26th January are national holidays and you don't require to take any leave.

Hello Madhura,
If your Company needs to function on 15th of August. Check whether your company has the Shop & Establishment act is filed.
If so you have to submit "Form 5A" to the Labor Department, at least a week back.
Main thing is that how ever the Salary has been paid (Cheque or Bank Transfer etc), the pay for the Employees who worked on that particular day should be given on that same day.
Hope the above statements would have made you clear. It's only with the Labor department who has the main issue working on holidays. Do check with Labor Department for further clarifications or Do message me specifically. I shall try to help you out.

Even if extra money is provided...we can say that is really bad..
But look what employers are saying now - Its recession, if you take a leave think abt your employment..
