Left Job Without Notice: Can I Still Claim My PF Money and How?

Hi,

I was working in a company from where I left without completing my notice period, which was two months. I only completed 15 days of it and left the company. They did not give me my experience certificate, relieving letter, and my salary for that month. I worked there for 1 year and 8 months, during which time they deducted PF from my salary. I left the company on January 31, 2009. Now, July 2009 has been completed.

Please guide me on whether I would be able to get my PF money or not. If yes, then how? If they are not willing to give it, what should I do?

Hi,

We would be able to transfer or claim the PF amount contributed to a particular concern. Various forms are available for this activity. When we approach the PF department, they require the form with the valid signature of that concern. Hence, you must have a contact with your earlier concern.

Dear Perry,

If you are aware of your previous PF establishment code and membership number, then apply for a transfer for your PF account in Form 13 from your current organization. I am suggesting this because I feel that withdrawing your amount will be a problem for you since your previous organization is not cooperating.

Regarding PF Withdrawal:

No employer can stop settling PF accumulations. Employees can fill out the relevant settlement forms and send them to the PF organization with a covering letter stating that the employer is not interested in signing the PF settlement forms. The concerned PF enforcement officer in the area will take action and ensure that the member's money is settled properly.

It is necessary to complete your notice period or you should pay against it. If the employer is not signing the form, then the PF officer will visit your previous employer and get it signed. However, there could be chances of upholding your PF account as you have not fulfilled the previous employment conditions.

I am advising you, if your current employer is providing PF, then you can provide them with the same number (Form 13) and get it activated by your current employer.

In case you are working in a covered establishment, you may seek the transfer of your previous employment by applying in Form 13 to your new employer's PF office.

In case you are not working, apply for withdrawal in Forms 19 and 10C. Whether you left after serving notice or not does not affect your PF; it cannot be attached or withheld. If your employer does not attest your forms, then apply directly to the concerned PF office. Have the form attested by the bank manager of the bank where your account is maintained.

PF officials can even have such delinquent companies prosecuted for not attesting.

Dear Perry,

If you want to withdraw your PF, you have to fill Form 19 & 10C completely and get it signed by any gazetted officer or your bank manager. Then, file it with the concerned PF office. There is no need to get it signed by your previous employer.

If you want to transfer the same, you have to fill Form 13 (transfer form). This form does not require any signature from the previous employer.

So, in any case, you can withdraw your PF without getting the signature of your previous employer.

I worked with an organization in 2005 for 6 months, but unfortunately, that organization has been shut down. Will I be able to claim my PF from the PF department? What should I do to get the amount?
