Can We Register for PF & ESI Now Without Issues from Past Non-Compliance?

Hello Everybody,

I work in an Export Company that has 58 employees, but we are not registered with PF or ESI. Now, suddenly, our management has decided to register the company with PF & ESI. So now, my query is that since many years we have not registered with PF & ESI, though we are legally entitled to do so, can we suddenly register, or will the ESI & PF departments look into our past records? Kindly suggest how to proceed.

Please apply for ESI & PF registration numbers. There is no need to show past records for ESI/PF offices. You only have to explain to the ESI/PF inspector who will visit your factory before allocating the ESI/PF number to your company. Please apply for ESI/PF numbers with immediate effect. There is no need to hire any consultant; you can easily do this job. Please let me know your company location. We have one person at Kasba Industrial area who can guide you better free of cost. Don't suggest hiring a consultant to anyone; everything is available on the internet or you can ask us.

Hi,

Almost all private companies will have their consultants take care of these compliance payments. I would advise consulting any of the CAs or lawyers nearby because they will know these consultants and can guide you. Alternatively, you might want to wait at the PF office; you'll see many consultants filing the returns in the first week of the month, typically on the 7th or 8th.

I have gone through your query and found the reply given by J.S. Malik is correct, while the answer provided by Global Overseas144 is incorrect.

When applying for P.F. & ESI numbers, the first question to address is the date on which the employee count exceeded 20, along with a monthly breakdown of employee details since inception. You are required to pay the P.F. & ESI contributions starting from the date the employee count exceeded 20.

I recommend forming a new company with all new documentation; otherwise, you will have to pay the PF/ESI contributions with interest from the date the count exceeded 20.

I suggest hiring a good consultant who can advise you accordingly after reviewing your Books of Accounts to determine the amounts allocated in the Salary & Wages account and the number of employees.

Another common query arises regarding how to check P.F. balance. You are advised to visit your P.F. office with your P.F. slip, where they will direct you to the relevant official responsible for your accounts, who will provide you with the exact status of your accounts.

Regarding a new account in PF, you have to provide the following documents in support:

(1) Proof of the date of commencement of your business.
(2) From the commencement of business, all books of Salary register and Attendance register need to be shown for verification. If necessary, copies should also be provided (it is compulsory).
(3) Copy of audited Balance Sheet of your company or firm from the beginning up-to-date.
(4) If any special registration certificates or registration numbers are allotted, that copy should also be submitted (for example: Registration Certificate from a State Board for Education if the concern is dealing in the Education Field (Schools, Colleges, etc.).
