How Should I Handle My Company Withholding My Final Pay Until I Finish Pending Work?

Please suggest to me. I resigned from my company with one month's notice, but they are not providing me with the full and final account, and they are asking me to complete the pending work. However, when I joined the company, there was pending work from the company's side as well. No one was available to address this pending work at that time, so I completed all the pending tasks. In doing so, my current work was affected as I had to prioritize completing the pending tasks. Now, the management is requesting that I finish all the work up to date before they release my full and final account.

When you have worked for the full notice period, you have every right to request a relieving letter and full and final settlement. Your organization is legally and professionally unjust by withholding your full and final settlement and pressuring you to continue working.

I suggest you discuss this matter with your management to resolve the issue. If the pending work is crucial and you are able to complete it, then consider doing so. However, there is no benefit in burning bridges.

Were the terms of separation not communicated to you earlier? If they were, one month should have been enough time to complete pending work without taking on any new tasks. If they were not communicated, speak to your management that you had given them the required notice as per the terms of your employment. If completing the pending work was their priority, they should have communicated it to you earlier. Ask them if they could reach a mutual agreement with you, which would be beneficial to both. I'm sure with a little tact, you should be able to navigate this sticky situation.

By the way, they cannot withhold your Full and Final settlement legally unless they incurred a loss due to your work during your employment tenure.

If at this time, I do old pending work, then the current work will also be pending because there is a lot of work here. I have already informed the management regarding the pending work due to a shortage of manpower. However, I have not received any positive response from the management.

Please provide me with details of your management as I know some labor inspectors in Maharashtra. Alternatively, you can refer to our services or NGO, and we will address the matter with your management. They cannot hold any funds without a valid reason; pending tasks are their responsibility.

Dear Senior,

I don't have any written contract between me and my company. Also, I don't have an offer letter, joining letter, or confirmation letter from my company. Should I give a legal notice to my company without the above-mentioned documents?
