Are Private Limited Companies Legally Required to Have Leave Policies? Seeking Guidance

My company is a Private Limited company, but they don't have any rules for leaves. As an HR Manager, I want to know if there is any obligation for a Private Limited Company to follow leave policies. If yes, kindly guide me with legal support.

Whether your establishment is covered under the Factories Act or the Shop and Establishment Act depends on the state in which your office is located, as specific state rules will apply for leave.

Dear Sir,

I am working in a construction company in Jamshedpur, Jharkhand. My company is a Private Limited (Pvt. Ltd.) entity and has been operating for the last 10 years. Currently, around 18 employees are working for this company. However, there are no specific rules and policies in place regarding leave, overtime, holidays, etc.

I recently joined as the HR Manager just six months ago. I would like to inquire if there are any government acts or regulations that are mandatory for Private Limited companies. I am keen on establishing these regulations within our company. Currently, the company policy involves deducting salaries for absences and reimbursing for up to 23 days of leave in each financial year.

I seek guidance on how to implement leave policies in our company that would be advantageous for both the employees and the organization.
