Is It Mandatory to Register Our Gurgaon Branch Under the Shops & Establishment Act? Seeking Guidance

The registered office of our company is situated in Hyderabad. We want to register our branch office in Gurgaon under the SHOPS & ESTABLISHMENT ACT, Haryana. Kindly provide your suggestion on whether it is mandatory to register our company under the act. Please also provide details regarding the authority where we need to register.

Registration would depend upon the nature of the business in which your company is engaged and the type of business conducted by your Gurgaon office. Registration is completed through the Office of the Labour Commissioner.

As per the Shops and Establishment Act, you are required to register under this act. The registered office is different from the branch office, and the authority is the area/divisional labour inspector (Labour Department) for shops and establishments.

Our Nature of Business is the same. In Hyderabad, it is also registered under the Shops and Establishments Act. So, do we need to register in Gurgaon as well to operate the branch?

Dear Manish,

In Haryana, Labour Inspectors are also working in the capacity of Shop Inspectors who are also looking after the registration work of shops. The Labour Department office is situated on the 4th floor, M S Gurgaon. So, approach the area Labour Inspector for this work. You can obtain the registration papers from the book-seller named Nand Book Stall, Sadar Bazar, Gurgaon.

Hi,

If your office is in Hyderabad and you have registered yourself with the Hyderabad location, there is no need to obtain a license in Gurgaon for the Hyderabad branch. An additional license is required for the Gurgaon office, but it is not connected to the Hyderabad office.

If a manufacturing factory is situated in one place, having a license under the Factory Act, and wants to lease a warehouse in another place in the same state, is it required to get registration under the Shops & Establishment Act in Haryana?

Dear Anil,

Yes, we are required to have registration under The Punjab Shops & Commercial Establishment Act, 1958, as applicable to the State of Haryana. A warehouse is covered under the definition of a 'shop' under this Act and hence requires registration.
