Understanding Leave Entitlements for Probationary and Permanent Employees Under the Factory Act 1948: Can Anyone Clarify?

Hi,

As ours is a manufacturing company, we follow the rules as per the Factory Act of 1948. Could anyone tell me about the leave entitlement as per the Factory Act, 1948 for employees on probation as well as permanent employees?

Dear Payal,

As per the Factories Act, one day of earned leave is to be given for every 20 days worked. Different states have different factory rules. You can obtain a copy of the factory rules from a book seller who deals with law books.

Dear Payal,

Please go through Chapter VIII of The Factories Act, 1948 regarding Annual leave with wages for the grant of EL. In my opinion, probationers and the confirmed employees are entitled to EL at the same rate. The probationary period is also to be considered for the grant of EL.

In Chapter 8 of the Factories Act, 1948, it is stated that for an adult worker, one day of leave is granted for every 20 days of work performed in the previous calendar year. For a child worker, one day of leave is given for every 15 days of work performed in the previous calendar year. The total accumulation of leave should not exceed 30 days for an adult and 40 days for a child.

Dear Mr. Khola,

Related to the above query, I also have a query regarding the Factories Act Chapter 8 Leave Rules. Only Annual Leave for 1 in 20 days of work is mentioned, but there is nothing specified for Casual/Sick Leave.

My question is, what type of leave should be provided according to the Central Factory Act - EL/SL/CL, and what is the minimum requirement?
