Understanding Annual Leave: How Should It Be Allocated and Broken Down for Employees?

Hi,

Can anyone help me with the minimum number of annual leave to be given to employees and the leave breakup of the same? If the annual leave is 21 days, how is the employee eligible to take it? Is it compulsory to incorporate the leave breakup, or can the management/HR Head decide at their discretion to allocate the leave?

Dear Latha,

Annual leave with wages is provided under either The Factories Act, 1948, or The State Shops & Commercial Establishment Act. You need to determine which of the Acts is applicable in your case. After this, please review the E L provision for the grant of these leaves.

Dear Lalita,

As per the Bombay Shops and Establishments Act 1948, the privilege of 21 days is granted to every employee who has worked not less than 240 days during a year, with an accumulation of leave up to 42 days.
