Contract Labour Act Dilemma: How Can a Contractor Get a License Without Employer Registration?

I have a query regarding the Contract Labour Act. If the principal employer is a government organization and the same is not registered with the Labour Department as the Principal Employer, how will the contractor obtain the Labour License?

Please provide the necessary circular.

Dear Sheetal Gupta,

Please take up the matter with the Principal Employer. What are they saying? You are also correct that without fulfilling the column of No. & date of registration in the application for a contract labor license, it will not be treated as complete in all respects.

To obtain a license, you need to fill out Form V. In this form, you must include your registration number and the date; otherwise, you will not receive the license.

The Principal employer is not registered with the Labour Dept. but they are insisting on a labor license.

Dear Sheetal Gupta,

In these circumstances, you need to take Form V from the Principal Employer and apply to the Licensing Officer under the CL (R&A) Act of your area to obtain the license in the prescribed application format. Submit the required license and security fees and inform your Principal Employer accordingly.
