How Can My Friend Secure His Unpaid Salary and Proper Relieving Letter from His Company?

My friend is working in a software company. Upon joining, he signed an agreement for two years. Currently, 1 year and 6 months have passed, but for the last 6 months, he has not received his salary from the company. He has informed HR of his intention to be relieved from the company. Initially, he started his career as a trainee software engineer, and as per the appointment order, he was to be promoted after one year. However, no appraisal has been conducted so far, and there has been no salary increment. The company is now refusing to provide the pending six months' salary, stating they will release him as a trainee software engineer.

How should he address this situation to receive his salary and obtain the relieving letter as a software engineer? Your immediate response is greatly appreciated as this is urgent.

You are advised to approach your area labor office for non-payment of wages for six months. If your monthly wages are more than Rs. 10,000, then ask the officer to take action under the State Shops & Commercial Establishment Act. For breach of contract, you can approach the civil court.

It is a breach of contract by the employer. I would suggest contacting the Labour Officer, filing a case against the employer, and then looking for another placement.

No employer can escape misappropriation of wages. This is a criminal offense. You must warn your employer, and if he doesn't pay your salary, then approach the Labor Commissioner. If you find that the Labor Commissioner is also managed by the company, file a police complaint against the employer. I hope he will immediately release you from the contract and pay all your back wages.

If your employer is a scoundrel, then no one will blame you in this world for taking action against him. Even your future employers will not mind this police action.
