Understanding Workmen's Compensation Act: Is Additional Insurance Necessary for Employees?

rguph
We have some employees who are covered under ESI, and the rest of the employees have been insured through the Group Health Insurance Scheme and Personal Accident Insurance. Despite that, is it necessary to take insurance under the Workmen's Compensation Act.

Dear,

Neither is it necessary nor legally required to take insurance cover under the Workmen's Compensation Act. Those whose salary is up to 10k might be covered under ESI. I personally do not feel inclined to provide insurance cover under the Workmen's Compensation Act to those who are not covered under ESI. They will not benefit significantly from the Workmen's Compensation Act as their nature of the job is not as such.

Thank you.

Dear,

It is advisable to get an insurance policy for those workers who are not covered under the ESI Act, 1948, and are covered under the definition of a worker under the WC Act, 1923, from an insurance company.

Dear Sirs,

Is it not sufficient since we have already obtained a Group Health and Personal Accident policy for the employees?
R.N.Khola
Dear,

It is also sufficient if you could benefit under these schemes and then payment may be made to the affected workman in accordance with the W.C. Act, 1923.

Dear RKN,

Is it permissible for a company to claim an amount from an insurance company under a Personal Accident Insurance Policy and pay a lesser amount to the nominees of the workers based on calculations reached through the Workers' Compensation policy?

Dear RNK,

Is it permissible to claim a higher amount through Personal Accident Insurance and pay less to the nominees of the workers as per the calculation of the Workers' Compensation Act in the event of death?

Under no circumstances is it possible to claim more from insurance companies and pay less as compensation.

Dear,

If the workman is covered under the WC Act, 1923, then the employer has to pay compensation in accordance with the provisions of this Act only.

Yes, it is compulsory. If the person is not covered under ESIC, then the person must be covered under the Workmen's Compensation Act, even if insurance is taken.

Can you suggest what will be the minimum medical coverage and group accidental policy under the Workmen's Compensation Act?
