Understanding Leave and License Agreements: Are They Governed by Rent Control Acts in India?

henna2008
Hi friends,

I want to know which law governs the leave and license agreement. Does it come within the purview of rent control acts? Is the leave and license agreement valid all over India or only in the state of Maharashtra?

Please help.

Henna

Dear Henna,

We are not in a position to understand your query. We have not heard of the subject matter on leave and license agreements in the HR field. You are also talking about the Rent Control Act. How are these interlinked with each other? Please be clear in putting the query.

Dear Henna,

The Leave & License Agreement falls under the Indian Easement Act, and the Rent Control Act does not apply to it. Upon registration of the L&L agreement, you are required to pay a fixed fee of 2000, as opposed to the amount for a Lease Agreement.

Dear Henna,

The Leave and License Agreement if executed in Maharashtra relating to a property in Maharashtra would be governed by the Maharashtra Rent Control Act. However, if the transaction falls under certain exemptions (section 3), then this Act will not govern it, and one would have to look at the Easementary Act for understanding parties' rights.

Regards,
Abe
