Dear Mr Abraham,
Yes, ALL Shops and Establishments registered under Shops and Establishments ARE expected to be closed on election days. They have been given permission to shift the weekly closing day to the day of election. Moreover, they are free to open for business after the scheduled hours for voting are over. If somebody willingly flouts the orders, it is their choice. But YOU, as an HR professional, is expected to be aware of the law. And if YOU want to please your bosses by giving them the wrong advice, it is your choice.

Dear All,
Now it is upto the Government & Election Commission of India to implement their instructions & section 135-B of Representation of Peoples Act.

You need to give holiday because not giving holiday will be treated as excuse by employee to not go to vote, so please do give holiday seems most HR just please their bosses by keeping offices open 24/7 and giving pressure to employees, :-x:-x:-x
bad bad practice, pls give leave tomorrow

Hi Supriya
There are lots of companies who have delcared holiday for election. However, it make sense to declare holiday for coporates only when we get notification from respective state govt. or election commission.

Hi all,
Pl declare holiday on election day. We at Hyderabad declared holiday as per the press note from the Election Commissioner.
Some of the organisations who have opened their offices on election day were served with a notice from the EC. Media was too enthusiastic to expose such cases. Pl take a call

I work in Pvt. Sector and I have noticed that there is a rarely a Holiday on Election Day. Pvt. Sector plays smart they instead give the option to employees to choose the same from their Leaves or Opt for Option Leave. If not, then they allow employees either to come 2 hours late in the morning or go 2 hours early in the evening. I think this way Election Day is celebrated in Private Sector how many Circulars Govt might issue it is null and void when the same is applicable to Pvt. Sector. Casting Vote just requires 2 minutes and if there is a line then may be maximum 1 hour you would get your chance so why waste the full day and making it a compulsory off as per logic given in Pvt. Sector make sense also.......Ultimately you guys choose what you want for your company.....We are working on the Day and Employee can decide but if work is there he can come late by 2 hours a short leave after casting his vote and work...

Hi Supriya,
This is with reference to your query regarding the Election Day.
For your ready reference please find attached herewith section 135 B of the Representation of the Peoples Act. By virtue of the same you shall have to declare a holiday on the Election Day.
As per the circular issued by Chief Labour Commissioner it has been declared as mandatory public holiday under Bombay Shop & Establishment act due to Lok-Sabha elections. For this also i have attached the PDF. Please go through it.

Thanks & Regards,
Jyo
