Urgent: PF Withdrawal On Unclean Exit From Current Company

sejalparikh
Hello,

I have resigned from my company, and want to be relieved within 15 days to start with a new phase of life. I am leaving my IT career and going towards community development by joining the internship at Community Health Cell - Community Health Cell - ANNOUNCING THE COMMUNITY HEALTH LEARNING PROGRAMME (CHLP)-2009

The fellowship is starting on May 4th, and I got very less days to give the company as notice period (15 days) as opposed to full 2 months. Here, HR does not start the exit formalities unless manager agrees, and my manager is not agreeing for smooth relieving. I also offered to come during late evenings and weekends to finish up my pending transition, but in vein. I do not have many options left (other than unclean exit) as this fellowship means a lot to me. Now that I am all set for another career, I don't think I would want to come back to IT path anytime later, so work exp certificate or relieving letter doesn't matter much. But I want to know if I will be able to get my PF on unclean exit? If yes, then how? Also what will happen to my IT form 16?

dear
see legally they are bound to give you form 16 if they refuses to do so u can make compalin to income tax authorities or consult some CA for that.
there is no problem to get PF ,let it be a any type of exit.
if employer refuses to vaify your form u can fill up form 19 and 10 c and deposit the same with PF office with a big letter that your employer is harashing and not attesting your form.it is the responsiblity of PF dept to get it attested from employer and release your fund.
tks

One quick question, in case due to some changes in my circumstances, I have to go back to the IT career, what problems I will face due to lack of the relieving letters and work experience certificate? So far I am not thinking of going back, but it is good to be informed in case circumstance change.
