Please let me know the exact meaning for the following notice period terms:
1. Notice Period

This contract of employment is terminate by either party giving one-month’s (30 days) notice during the training / probationary period. After confirmation or services, either party will have to give one month’s (30 days) notice for every year of completed service, or a part thereof exceeding 6 months, subject to a maximum of 3 months (90 days). For the purpose of calculating of notice period, the completed period spent in the service of the company including training / probationary period will be taken into account. The Company reserves the right to pay or recover salary in lieu of notice period. Further, the Company may at its
discretion relieve an employee from such date as it may deem fit even before the expiry of the notice period without compensation for the remaining period and is not bound to give any reason thereof

Nowadays in IT industry, persons serving in notice period are getting more than 2 or 3 offers and getting hike in their CTC by showing the other offers. Hence the CTC of particular skill set is getting high and high.Finally all other HR/Consultacts are the looser after putting efforts to release the offer.

I have resigned giving 15 days notice. According to appointment letter one month notice is required. But company is normally not following this procedure. The company has been relieving employees against notice period of 10 to 15 days. I have followed this procedure. But now company is deducting the notice period of 15 days. When I have resigned, they have never asked me to give notice period of one month then how can they deduct my notice period amount.

Can any body tell me that notice period salary is only basic +DA or full salary (CTC) for the month.

If any imployee has completed 1.5 yaears of service without neither getting confirmation letter in writing nor it is mentioned in the appointment letter that after completion of six month probation period that he will be deemed as confirm employee will he have to serve the notice period of one month or what kindly clerify.

Sir, I worked in a company for 11 months and as per appointment order, both the parties have to give the three months notice. Due to their pressure & harassment I submitted my resignation as they requested and quit the company. Now they didn’t get any replacement. Now they are issuing legal notice for 3 months gross salary and legal fee also. Actually they only got resignation forcefully from my end and I didn’t demand any compensation also from their end because I got job through some reference in their company. Now the old company issuing legal notice and court summons. What is the way to get my actual compensation (salary, bonus, gratuity, ROS, Leave Encashment etc) from that company and whether I need to pay any notice pay since the resignation given on last day (as per paper I didn’t completed notice period, but orally both the parties agreed). Please suggest me how to get the claim.

Thanks for your suggestion. In my case, company got resignation by torturing & harassing. Now they are demanding for 3months notice as per appointment letter. Even that company didnt have Standing Order also. I refused to pay for 3months notice and company has issued court samoons by filing case in labour court. Pls let me know what to do and how to go ahead. I didnt have financial backgroud to challenge the company in court and even my Colleagues are getting fear to give witness for the same (Bcoz of job security problem from company's end. Pls suggest me what to do.

Whats the Maximum Notice Period allowed to company Legally...is 4 months Notice Period and PLUS 4 months Salary is valid as per Indian Law?
