Sorry! there were some mistakes, so i'm posting it again after a minor rectification.
I resigned from my previous job on 30th January, 2009. I
communicated about this a week ago from the date of
resignation. (that means i gave the company one week's notice).
My salary for the month of December, 2008 was cleared on 23rd
January and and I informed the company on 24th January, 2004.
The M.D. of the company accepted my resignation. But my
salary for the month of January 20009 (i.e. for 30 days of
January, 2009) hasn't been cleared till date. I got fed up of calling
the accountant again and again as he kept on making various
excuses.
When I finally called up the M.D. on 21st Feb,2009, he told me I
was supposed to give one month's notice before resigning. I told
him one month's notice is required only when the employee is
given appointment letter and/or offer letter and I wasn't given any
of them. So, there's no question of 1 month's notice. Since I
informed them before seven days from the date of resignation,
one month salary is still outstanding. If I would have informed
them three days earlier, I'm sure the company might have
blocked my salary for the December, 2008 as well. In such circumstances, informing a month ago might have resulted in the blockage of 3 month's salary.
But he told me to keep on calling the accountant and coming
down to office whenever I'm asked to. Whenever he would wish,
he will make the settlement. I fell like mentally harrassed.
I've still been calling the accountant and it's in vain.
What should I do?
What should I do now to recover my outstanding salary?
Can I file a case in labour court against the company?
