Navigating Employee Accidents During Notice Period: Can Leave and Bonuses Be Adjusted?

Dear All,

Please advise me - if an employee is on a notice period of 2 months and he has already served 1 month and 10 days of the notice period, but suddenly he met with an accident during the notice period. As he requested, can we adjust his SL/PL against the remaining notice period and can we give him the remaining amount of performance bonus?

Hi Kiran,

Yes, if it was reality, then as per his request, he should be considered for adjustment of CL/PL. All full and final settlement should be done as it is done for other persons.

Hi Kiran,

As stated by Mahesh, you can adjust his leave for the remaining days of his notice period. If there are no leaves remaining, then the remaining days will be on LWP (leave without pay) basis.

It is just the understanding between the employee and the HR. It's always better to mend for the welfare of our employees. Since it is a critical situation, the best way is to adjust the leave balance with the notice period. Let's also not bring in LWP even if he does not have enough leave pending. Relieve him from all his duties and settle his performance pay with his F & F.

The 30-day notice period means 30 working days. Can an employee take leaves pending in his account during this period? What does the law say?
