Maternity Benefits and Gratuity Changes: Have New Amendments Been Passed?

Has any amendment been passed regarding Maternity Benefit and Gratuity?

i.e.,
Gratuity: 1 year eligible
Maternity: 3 years leave

As per the Gratuity Act, after completion of 5 years of continuous service, he/she is eligible for gratuity. My question is whether any amendment has been passed that would make an employee eligible for gratuity after completing 1 year of service.

ESI: Has maternity leave been increased from 12 weeks to 2-3 years?

Dear Ramalingam,

As per the Gratuity Act, there has not been any change or amendment from 5 to 1 year. The Maternity leave has been modified, but only for Government employees. Under the new rules, the 3 months maternity leave has been increased to 6 months (3 months pre and post-delivery). Additionally, the female employee can avail of 2 years of paid leave at any time until the child turns 18. Therefore, if you are in a Government organization, this rule is applicable to your employees.

Hi all,

It is surprising that I too saw an article about maternity leave being proposed to be extended to six months with numerous additional benefits, but it is still under progress and has not yet been passed as a bill. This change will surely have a significant impact on today's industrial scenario. I hope this is for governmental organizations and not for the private sector.

Discussing this matter further will add more value. Please share your views on this.

As per the Gratuity Act, an employee is eligible only after 5 years of completion of his service, and there have been no changes or amendments to this. The maternity leave has been extended from 3 months to 6 months, but this change applies only to government employees.

Hi Ranjeet,

Could you please correct the government employee means State or Central because when verified in the State, they said they haven't received any circular. It would be great if you could provide details regarding this. Thanks in advance.
