Navigating Certified Standing Orders: Can Anyone Share a Draft and Guide on Procedures?

Dear All,

I am working in a manufacturing company where 300+ workers are employed. Now, as per legal requirements, the entity should have Certified Standing Orders. Previously, it was governed by the Model Standing Orders (Industrial Employment) Act.

Could anybody provide me with a draft of Certified Standing Orders and the procedures to obtain certified standing orders, so that I can have a clear picture?

Model Standing Orders given in the Industrial Employment Standing Orders Act itself can be the base for you. Once the provisions are discussed, whatever modifications are required can be made in consultation with the employees. You can then send it to the Labour Department (Assistant Labour Commissioner of the area) for certification. Once the drafted standing orders are certified by the competent authority, i.e., the Assistant Labour Commissioner, they become your 'certified' standing orders.

I want to submit an application for certification of standing orders by the labor commissioner, similar to a covering letter for Himachal Pradesh. Please help.

Is it compulsory to have 50 employees to create a standing order?

The Standing Order applies to industries with 100 or more workmen employed. Within six months of the Act coming into effect, the employer must submit five copies of the draft Standing Orders to the Certifying Officer.
