Earlier workers engaged at sites (only those engaged at sites) of the construction companies were excluded from ESI coverage. However, now all employees are covered.

Dear Mr. Balaji
I have mentioned that ESI Act is not applicable for construction Industries and not for BOCW Act. For Registration under BOCW Act is exempted for those who got covered by Factories Act and Mines Act and the construction work cafrried out for self and the cost is within 10 Lakhs.

Can any body guide me regarding the whole procedure of EPF Act for the Building and Cosntruction work.
1. Whether Colour Contract applicable under EPF Act.
2. Whether Electrical Contract work applicable under EPF act.
3. Whether the employee who has not worked more than 80 days is applicable under EPF Act.
4. Near about 90% Staff of Construction sites are movable from 1 construction to the other sites of different construction then how it possible to deduct EPF amount?
5. All 90% worker are oriented of there skilled so they are been given work for 2 or 3 months only so whether they are applicable under EPF Act?

1. Whether Colour Contract applicable under EPF Act.

What is Colour Contract. Are you mentioning the Painting Contract. All the workmen are to be deducted PF.

2. Whether Electrical Contract work applicable under EPF act.

All contractors are to pay the EPF for the workmen engaged by them.

3. Whether the employee who has not worked more than 80 days is applicable under EPF Act.

Even the workmen worked for 1 or 2 days also to be deducted EPF. (Please refer Section 16 & 17 of EPF & MP Act, 1952.

4. Near about 90% Staff of Construction sites are movable from 1 construction to the other sites of different construction then how it possible to deduct EPF amount?

PF is to be deducted from the employees and added with employer PF and deposited in the respective PF Office where their company have got registered. You can deposit the PF of Chennai Based company working in Assam or Kashmir or Rajasthan at Chennai on their respective Establishment Code, through your registered Office.

5. All 90% worker are oriented of there skilled so they are been given work for 2 or 3 months only so whether they are applicable under EPF Act?

Even you have to pay the PF for 1 or 2 days too. But for the work carried out on emergency purpose, PF is not required to be deducted for which you have to prove that the work was carried out on emergency purpose only.

Kindly guide me workmen rest hours & how frequent rest time to be given for construction workers during the working day,

Dear Mr. Bhuvaneshwaran
Please refer Section 28 of BOCW Act, in which the Hours of work is explained.
You can refer Section 51 to Section 66 (Chapter VI) of Factories Act for further complete details of Working Hours, Spread Hours, Rest Hours, Weekly off, Compensatory Off and other relevant details.
Hope I have cleared all your doubt. In case of any further doubt never hesitate to ask.
