As per my knowledge if leave is taken before and after Sunday, it should be calculated as 3 days.

Hi,
There already are many response on this, I would suggest to design your own policy now as you have already obtained suggestion from many of us.
There are many companies which deduct three days including Sunday, and there are some which does not do so.
SO, dear the ball is in your court now, it is your decision.
Deducting 2 days is a better policy as per my opinion.

Hi Shiela,
As per my Experience, you should consider 2 days of leave/deduction for your employee & ask him/her to compensate on other general holidays. It would be fair for a employer to give employee such a cushioning so that they can have feel good factor/motivated.

u are on the right track, even we follow the same.
Not only its applicable for w/offs but also for all public holidays.
Ours being a MNC we follow global policies only,

If the employee takes casual leave on Saturday and Monday, then only two days leave will be deducted and Sunday will not be counted. But if the Employee takes earn leave, then Sunday will be counted and 3 days leave will be deducted. This is the provision in every State's Shop and establishment act. Every state has its own act but they are similar in their provisions. A state's Shop and Establishment Act cover Offices like corporate offices, shops, Malls, Law firms Etc. Similar type of provisions are contained in Factory Act which applies to all the manufacturing units and factories.
Some companies adopt good HR Practices and they give relaxation to employees by giving more casual and earn leaves. Such companies do not follow rigid rules and so do not deduct any leaves on Holidays. but these companies are rare.

Is it compulsory for every company. Is the number of Holidays is fix.

Hi Anand,
In India public holidays are enumerated in every state's Shop and Establishment, Factory act or various Government Notifications. Three holidays are cumpulsory and these are 26th Janurary, 15th August and 2nd October. No establishment can be opened on these three days. other festival days may be declared as holidays based on the company policy. As a general practice instead of giving many one day holidays management prefers not to declare one day small festivals as holidays but on big festivals like Diwali or Holi 5-6 days continuous holidays are declared.

The leave Policy will also depend on your no. of working days in a week. If you are a organization working only 5 days , then you can can count Friday or Monday in the CL /EL/SL calculation.

Leave policies vary from organisation to organisation. However, one commonly observed rule is that casual leave can be prefixed or suffixed to holidays whereas earned leave/privilege leave cannot be availed in this manner. You can take friday and following monday as casual leave and get the benefit of four days of absence. If the leave taken is of any other kind, the holidays also are counted.
